Procedural Posture

Constitutional Petition / Ruling on Interlocutory Application

  1. 1 Whether Kitui CMCC No. 336 of 2014 should be transferred to the Environment and Land Court.
  2. 2 Whether the suit is res judicata and should be dismissed.
  3. 3 Whether the Petitioners are entitled to injunctive relief restraining the Respondents from interfering with the suit land.

The Chief Magistrate's Court in Kitui is duly gazetted to hear land disputes within its pecuniary jurisdiction, and the Petitioners failed to demonstrate why the matter should be removed from that forum. The question of whether the suit is res judicata should be raised and determined in the pending suit itself, not by way of a separate constitutional petition. The court concluded that the current Petition and Notice of Motion amounted to an abuse of the court process, as the issues raised could and should be addressed in the original suit....
