Procedural Posture

Civil Appeal / Ruling on Stay of Execution Pending Appeal

  1. 1 Whether the applicant has satisfied the conditions for grant of stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules.
  2. 2 Whether substantial loss will result to the applicant if stay is not granted.
  3. 3 Whether the application for stay was made without unreasonable delay.

Ratio Decidendi

The court found that both parties are elderly and of limited means, and that the applicant would suffer substantial loss if execution proceeded, as the respondent, having closed her business and being unemployed, may not be able to refund the decretal sum if the appeal succeeds. The application for stay was filed within twelve days of judgment, which the court deemed to be without unreasonable delay. Given the circumstances and the status of the parties, the court determined that it would be in the interest of justice not to impose any terms regarding security. Accordingly, the court granted an unconditional stay of execution pending the hearing and determination of the appeal.

Court Disposition

Application for stay of execution granted.
