The court found that there was no substantive judicial review motion filed after leave was granted in 2010, and thus no suit was pending in which the applicant could be joined. The application for leave was spent upon the grant of leave, and the file was only meant for obtaining leave, not for substantive proceedings. As such, the application for joinder was misconceived and amounted to an abuse of the process of the court. The court accordingly dismissed the application and marked the file as closed.
