Ratio Decidendi

The Court of Appeal found that the proceedings before the High Court were conducted in flagrant disregard of elementary procedural rules. The court held that no valid judicial order can stand if obtained in such a manner, regardless of the seriousness of the allegations involved. Consequently, the Court of Appeal granted a stay of all orders made by the High Court on 31st December 1998 and reinstated the receiver, Mr. Charles Kariuki Gathungo, to preserve the status quo pending the determination of the appeal.
