The High Court held that it lacks jurisdiction to review its own resentencing order after having already exercised that jurisdiction, as doing so would amount to sitting on appeal over its own judgment, which is prohibited by the doctrine of functus officio. The court found that the application did not disclose any new matter or error apparent on the face of the record and that the applicant had already benefitted from resentencing. The proper forum for further relief is the Court of Appeal or the committee on power of mercy. Accordingly, the application was dismissed as lacking merit and being an abuse of the court process.
