Civil Appeal / Judgment

  1. 1 Whether the provisions of the Government Proceedings Act apply to county governments.
  2. 2 Whether section 13A of the Government Proceedings Act is constitutional and valid.

Ratio Decidendi

The High Court held that the Government Proceedings Act applies to both National and County Governments, as required by the Constitution and its transitional provisions. However, section 13A of the Act, which mandates prior notice before instituting proceedings against the government, is unconstitutional as it violates Article 48 of the Constitution guaranteeing access to justice. The trial magistrate erred in striking out the suit for non-compliance with section 13A, as that provision has been found null and void. Consequently, the appeal was allowed, the order striking out the suit was set aside, and the suit was reinstated for hearing.
