Ratio Decidendi

The court found that as at 30th April, 2009, when the memorandum of appeal was filed, the Civil Procedure Rules were not applicable to the proceedings of the Cooperative Tribunal. Section 78(5) of the Cooperative Societies Act allowed the Tribunal to regulate its own procedure, and there was no evidence of any rules promulgated prior to Legal Notice No.59 of 2009. The Civil Procedure Rules only became applicable to Tribunal proceedings after 12th May, 2009, by virtue of Legal Notice No.59 of 2009. Therefore, the requirement for leave under Order III Rule 9A did not apply to the filing of the memorandum of appeal in this case. The application to strike out the memorandum of appeal was thus...
