Ratio Decidendi

The respondent did not contest the allegations, and the petitioner's testimony was found credible and consistent. Although the petition should have been filed in a magistrate’s court, the High Court exercised original jurisdiction, noting that the Act did not bar it from hearing the matter. The prayer for custody was abandoned as it had already been addressed by the children’s court. The court therefore granted the dissolution of the marriage and awarded costs to the petitioner.
