Ratio Decidendi

The Tribunal found that both the tenant and sub-tenants had vacated the suit premises, rendering the Tribunal functus officio on most issues. No sufficient evidence was presented by either the landlord or the tenant to substantiate claims of rent arrears against the sub-tenants. The landlord failed to provide a rent book or statements of account, and the tenant did not provide proof of default by the sub-tenants. The Tribunal concluded that, in the absence of evidence and with the parties having vacated, it could not make a finding on rent arrears. The applications were therefore dismissed, and each party was ordered to bear its own costs.
