The court held that, although the applicants sought leave to commence contempt proceedings ex-parte, the prevailing legal position in Kenya requires that such applications be served on the intended respondents for inter-partes hearing unless there is demonstrated prejudice to the applicant. The court found that no prejudice would be suffered by the applicants if the respondents were served, and that the ends of justice would be better served by allowing the respondents to participate and adduce any relevant material. The court relied on the Court of Appeal decision in Republic v Judicial Commission of Inquiry into the Goldenberg Affair & Another ex-parte Koinange & 3 Others (No. 2) (2003)...
