Ratio Decidendi

The court found that the applicant failed to satisfy the mandatory conditions for grant of stay of execution pending appeal as set out in Order 42 Rule 6(2) of the Civil Procedure Rules. Specifically, the applicant did not demonstrate the kind of substantial loss he would suffer if stay was not granted, nor did he furnish security for the due performance of the decree. Although the application was filed without undue delay, the absence of evidence of substantial loss and failure to provide security were fatal to the application. The court also noted the applicant's failure to file written submissions as directed, which indicated lack of seriousness in prosecuting the application....
