Legal Issues
- 1 Whether the applicant's custodial sentence should be revised in light of the sentence review report.
- 2 Whether a non-custodial sentence is appropriate given the applicant's age and circumstances.
Ratio Decidendi
The court exercised its revisionary jurisdiction under Section 364 of the Criminal Procedure Code after considering the positive sentence review report and the applicant's young age. The judge determined that a custodial sentence was not ideal in the circumstances and that a community service order would better serve the interests of justice and rehabilitation. Accordingly, the original sentence of a fine of Ksh. 15,000 in default nine months imprisonment was set aside and substituted with a community service order for nine months at the Chief Camp, focusing on environmental work.

Ruling
1. This matter having been placed before me this morning to exercise my revision jurisdiction under Section 364 of the Criminal Procedure Code. I have perused the Record and noted that the sentence review report on the applicant is positive.
2. He was sentenced to serve 9 months. I find that the sentence of imprisonment may not be the most ideal considering his relatively young age.
3. I alter the sentence of fine of Ksh. 15,000/= in default 9 months and substitute therefore with an order that he serves community service for a period of 9 months at the Chief Camp to plant trees and turn the place green. It is so ordered.
