Procedural Posture

Tribunal Application / Ruling on Application for Review and Preliminary Objection

  1. 1 Whether the matter is res judicata.
  2. 2 Whether the orders of review and setting aside can issue.

Ratio Decidendi

The tribunal found that the matter was not res judicata as there had been no previous application for review or setting aside of the orders in question. The tribunal retained jurisdiction to hear the application. However, upon examining the evidence, the tribunal determined that the statements presented by the applicant were not new or important evidence, as they had already been considered in the earlier ruling. The application did not meet the legal threshold for review under Order 45 Rule 1 of the Civil Procedure Rules, 2010. Consequently, both the preliminary objection and the application for review were dismissed, and costs were awarded to the landlord.

Court Disposition

Application for review dismissed; preliminary objection dismissed; costs awarded to landlord.

Orders
