Ratio Decidendi

The court found that the Claimant was dismissed on 10th November 2010 and filed his claim nearly nine years later, well outside the three-year limitation period prescribed by Section 90 of the Employment Act, 2007. The Claimant's argument that there was a continuing injury due to non-payment of final dues was rejected, as any such claim should have been brought within twelve months of cessation of the alleged injury. The court held that the delay was inordinate and that the suit was time barred. Consequently, the court lacked jurisdiction to entertain the claim and dismissed the suit.
