Ratio Decidendi

The Tribunal found that both parties are children of the deceased registered proprietor of the suit premises and that there was no evidence of a landlord/tenant relationship between them. There was no tenancy agreement, nor evidence of rent payment or receipt. The Tribunal's jurisdiction is limited to disputes arising from controlled tenancies as defined under Cap. 301. In the absence of such a relationship, the Tribunal lacks jurisdiction to hear and determine the dispute. The preliminary objection was upheld, the application dismissed, and interim orders vacated. Each party was ordered to bear their own costs.
