The Court of Appeal held that its jurisdiction to entertain an application for stay of execution under Rule 5(2)(b) of the Court of Appeal Rules is only activated upon the filing of a notice of appeal. In this case, the applicant failed to exhibit or demonstrate that a notice of appeal had been filed, nor did he provide a copy of the judgment intended to be appealed against. Without a notice of appeal, there was no competent appeal before the court upon which the orders sought could be anchored. Consequently, the application was incompetent and was struck out.
