Ratio Decidendi

The court found that the issues raised in the present application and suit had already been determined by the Kajiado Dispute Tribunal and adopted as a judgment in Kajiado PMCC No. 67 of 2009. The parties and subject matter were identical, and the applicant had already obtained the necessary orders to secure his claim over the suit property. The court held that it was not open to re-litigate the same issues, as doing so would contravene the doctrine of res judicata. Consequently, the application and the entire suit were dismissed, as the court lacked jurisdiction to entertain matters already conclusively determined by a competent tribunal and adopted by a court of law.
