Ratio Decidendi

The court held that under Rule 7 of the Advocates Remuneration (Amendment) Order, interest at 9% per annum is chargeable from one month after the delivery of the bill to the client, provided the claim for interest is made before full payment. The evidence showed the bill was delivered on 29th November, 2006, so interest accrues from 29th December, 2006. Interest is only chargeable on the taxed amount, not the amount originally billed. The court also found that the advocate, acting in person, is not entitled to costs but is entitled to disbursements. Accordingly, the advocate was awarded interest at 9% per annum from 29th December, 2006, until payment, and disbursements for the application.
