Procedural Posture

Civil Suit / Post Judgment Ruling on Scope of Account Reconciliation

  1. 1 Whether the reconciliation of the plaintiff's loan accounts should cover the period up to the date of judgment or extend beyond it.
  2. 2 Whether the report prepared by IRAC complied with the judgment's terms.

Ratio Decidendi

The court found that the judgment ordering reconciliation of the plaintiff's loan accounts did not specify a period for the reconciliation. Interpreting the judgment, the court held that it could not have intended to speculate about future periods beyond the evidence presented at trial. Therefore, the reconciliation must be limited to accounts in existence as at the date of judgment, 3/7/2020. The IRAC report, which extended the reconciliation to 2023, was set aside as it went beyond the scope of the judgment. The court directed that a new reconciliation be conducted up to 3/7/2020 only.

Court Disposition

Report of IRAC dated 30/11/2023 set aside; reconciliation to be done up to 3/7/2020.

Orders

  • The report of IRAC dated 30/11/2023 is set aside.
