Procedural Posture

Miscellaneous Application / Ruling on Reference Against Taxing Officer's Decision

  1. 1 Whether the taxing officer erred in refusing to tax the advocate/client bill of costs.
  2. 2 Whether advocate/client bills and party and party bills are distinct and should be taxed separately.

Ratio Decidendi

The court held that the taxing officer misapprehended the law by refusing to tax the advocate/client bill of costs. The court clarified that party and party bills and advocate/client bills are separate and governed by different scales under the Advocates (Remuneration) Order. The refusal to tax the advocate/client bill on the basis that the advocate should have claimed fees during party and party taxation was erroneous. Consequently, the court set aside the taxing officer's order, reinstated the advocate/client bill, and directed that it be taxed afresh before a different taxing officer.

Court Disposition

reference allowed; taxing officer's order set aside; advocate/client bill to be taxed afresh

Orders

  • The order of Miss Ndungu dated 11/8/2005 is set aside.
  • The advocate/client bill of costs dated 21st October 2004 is reinstated.
