The court found that although the Plaintiff had been in possession of the suit property since 1964, the statutory period for adverse possession could only begin to run from 14th January 2000, when the property was first registered. By the time the Plaintiff filed suit in 2008, the required 12-year period had not lapsed. The Plaintiff's occupation prior to registration could not be counted for purposes of adverse possession under the Limitation of Actions Act. Consequently, the Plaintiff failed to prove his claim for adverse possession on a balance of probabilities and was not entitled to the reliefs sought.
