The court found that the Defendant’s goods had been attached by auctioneers at the Plaintiff’s instructions and remained unsold in the auction yard. Since the attached goods had not been sold, execution of the decree was not complete. The Plaintiff could not properly seek a notice to show cause for committal to civil jail or claim an outstanding decretal sum while the attached goods were still in the auctioneer’s custody. The court held that proceeding with the notice to show cause under these circumstances would be unconscionable and an abuse of court process. The Plaintiff must either complete the sale of the attached goods or restitute the Defendant before seeking further execution....
