Procedural Posture

Civil Case / Ruling on Preliminary Objection to Garnishee Application

  1. 1 Whether the defendant/judgment debtor has locus standi to file a garnishee application under Order 23 of the Civil Procedure Rules.
  2. 2 Whether the application by the defendant is competent and properly before the court.

Ratio Decidendi

The court held that under Order 23 of the Civil Procedure Rules, only a decree holder is legally mandated to make a garnishee application. Since the application was brought by the defendant, who is the judgment debtor, he lacked the requisite locus standi to file such an application. This defect rendered the application incompetent and fatally defective. The court was persuaded by the arguments of the intended garnishee and found that the preliminary objection had merit. Consequently, the defendant's motion was struck out with costs to the intended garnishee.

Court Disposition

Defendant's application struck out; preliminary objection upheld.

Orders

  • The motion dated February 4, 2022 is struck out with costs to the intended garnishee (Ethics & Anti-Corruption Commission).
