The evidence regarding the alleged theft was inconclusive, and the Respondent did not follow the mandatory procedural requirements before terminating the Claimant's employment. The court held that the termination was unfair and unjustified under Section 45 of the Employment Act. As the Claimant had already received payment in lieu of notice and leave, and was a member of NSSF, the only remedy awarded was 12 months' salary as compensation for unlawful termination, along with a Certificate of Service and costs of the suit.
