Consequently, the claim for unfair and unlawful termination could not succeed. However, the trial court erred by failing to analyze and determine the claims for unpaid leave, rest days, house allowance, service pay, and unpaid salary, and by not awarding the sum of Kshs. 34,300, which was admitted by the respondent. The appeal was therefore partially allowed to the extent of the admitted sum, and the remaining undetermined claims were remitted to the lower court for determination by a different judicial officer.
