The bank failed to open the required escrow account and allowed the proceeds to be withdrawn by the principal debtor, thereby breaching its duty to the plaintiff. This breach led to the wrongful consolidation of the LPO loan with the plaintiff’s mortgage, increased interest rates, and ultimately the loss of her property.
