Ratio Decidendi

The court found that although there was a sale agreement between Karia and Gathungu for 19 acres of land and the Land Control Board consent was obtained, the Plaintiff's claim was statute-barred. The limitation period under Section 7 of the Limitation of Actions Act runs from the date the cause of action accrues, not from the appointment of administrators. Since the agreement and consent were from 1986 and 1987 respectively, the 12-year limitation expired by 1999. The suit, filed in 2016, was therefore time-barred and unenforceable. The Plaintiff was not entitled to any of the reliefs sought. No order as to costs was made since the Defendants did not attend court.
