  1. 1 Whether the claim was filed outside the statutory limitation period under section 90 of the Employment Act, 2007.
  2. 2 Whether the court has jurisdiction to entertain a claim filed outside the prescribed limitation period.

Ratio Decidendi

The court found that the claim was filed on 5th February 2014, which was more than three years after the alleged wrongful dismissal on 2nd July 2008. Section 90 of the Employment Act, 2007, which came into force on 2nd June 2008, expressly prohibits the filing of employment claims after three years from the accrual of the cause of action and does not provide for any extension of time. The court held that it lacked jurisdiction to entertain the claim as it was statute-barred, and therefore dismissed the claim with no order as to costs.
