The Employment and Labour Relations Court lacks jurisdiction to enforce awards made by the Director of Occupational Safety and Health Services under the Work Injury Benefits Act. The proper procedure for enforcement is for the applicant to move the Magistrate's Court by way of a miscellaneous application for adoption of the award, not by filing a full claim or application before the Employment and Labour Relations Court. The court's appellate jurisdiction under Section 52(2) of WIBA precludes it from acting as both an enforcing and appellate body in respect of the same award. The applicant's application is therefore not properly before the court, and the orders sought cannot be granted....
