Ratio Decidendi

The court found that the notice of withdrawal was filed after the suit had been set down for hearing and judgment on admission had already been entered in favour of the plaintiff. Under Order 25 Rule 2 of the Civil Procedure Rules, withdrawal at this stage required either the written consent of all parties or leave of the court, neither of which was present. The Deputy Registrar lacked jurisdiction to endorse the withdrawal notice after judgment had been entered, rendering the order adopting the withdrawal void. Consequently, the notice of withdrawal and its endorsement were invalid and set aside, regardless of the circumstances under which the notice was procured.

Court Disposition

Application allowed. Notice of withdrawal and consequential endorsement set aside.
