The court found that the notice of withdrawal was filed after the suit had been set down for hearing, and therefore, under Order 25 Rule 2 of the Civil Procedure Rules, withdrawal could only be effected with the written consent of all parties or with leave of the court. The Deputy Registrar's endorsement of the notice without such consent or leave was without jurisdiction and thus void. The notice of withdrawal was therefore invalid and incompetent, and the consequential order adopting it was set aside. The court emphasized that the procedural requirements for withdrawal after a suit is set down for hearing are mandatory and were not complied with in this case.
