The evidence showed that Nduati Waititu, the Plaintiffs' grandfather, only intended to purchase the land but died before making any payment. The purchase consideration was paid by Mwangi Nduati and Njoroge Nduati after being ordered by the Land Consolidation Committee in 1958. There was no credible evidence that the Plaintiffs' families contributed to the purchase price.
