Ratio Decidendi

Upon termination of the lease, the Defendants' continued occupation was unauthorized and amounted to trespass. The Plaintiff did not prove actual loss but is entitled to nominal damages for trespass. The court granted a permanent injunction restraining the Defendants from trespassing, ordered the Plaintiff to issue an eviction notice, awarded Kshs. 150,000 as nominal damages, and granted costs and interest of the suit.
