Environment and Land Case / Ruling on Application for Removal of Cautions

  1. 1 Whether the defendants have satisfied the conditions for removal of a caution under Section 73(1) of the Land Registration Act.

Ratio Decidendi

The court found that the cautions were registered by the plaintiff in 2009 and that the underlying suit was determined in 2014, with the plaintiff's appeal also dismissed. The court held that the purpose of a caution is to provide temporary protection pending resolution of a dispute, not to exist indefinitely. Maintaining the cautions for over fifteen years after the conclusion of litigation is unjustifiable and infringes on the defendants' property rights. The court concluded that there was no legal justification for the continued existence of the cautions and ordered their removal by the Land Registrar, Kiambu County.

Court Disposition

Application allowed. Cautions to be removed. No order as to costs.

Orders

  • The Land Registrar, Kiambu County is ordered to remove the cautions registered on Kabete/Nyathuna/2749, Kabete/Nyathuna/2750, Kabete/Nyathuna/2751, Kabete/Nyathuna/2752, and Kabete/Nyathuna/2753 forthwith.
  • There shall be no orders as to costs.
