The appeal is not frivolous as it raises arguable grounds on the quantum of damages awarded. To balance the rights of both parties, the court ordered that half of the decretal sum be deposited in a joint interest earning account in the names of the advocates for the parties as security, and granted a stay of execution pending the determination of the appeal.
