The respondent failed to discharge the evidential burden to prove ability to refund. However, the bank guarantee provided by the appellant was not acceptable as security because it was issued to the insurer, not the appellant, and had expired. Therefore, the court granted a conditional stay of execution, requiring the appellant to deposit the decretal sum in an interest-earning joint account of both counsels as security for the due performance of the decree.
