Ratio Decidendi

The court found that the applicant had complied with the directions issued by the Chief Magistrate requiring the transfer of the suit from Kiambu Law Courts to Kikuyu Law Courts. The application was properly served on the respondents, who failed to respond or appear. There being no opposition and the application being meritorious and in line with Section 18 of the Civil Procedure Act, the court allowed the application and ordered the transfer of the suit as prayed. Costs were ordered to be in the cause.
