Ratio Decidendi

The court found that the County Secretary is not the accounting officer of the County Government of Kiambu and therefore is not the proper party to be compelled by mandamus to satisfy the decree or pay the taxed costs. The relevant statutes and case law establish that the County Executive Committee Member for Finance, or another designated accounting officer under Section 148 of the Public Finance Management Act, is the person responsible for managing county finances and liable for such obligations. Since the application was brought against the wrong party, the court could not grant the orders sought. Consequently, the application was struck out with costs to the respondent.
