The court held that this constituted substantial loss justifying a stay of execution. Given that the applicant had not defaulted in paying the agreed rent, the court deemed it unnecessary to require security for due performance. The applicant was ordered to continue paying the original rent of Kshs. 130,000 per month pending the determination of the appeal, which should be prosecuted expeditiously.
