The Tribunal found that, in the absence of written agreements evidencing rent variations, the contractual rent of Kshs. 70,000.00 per month applied, subject to a Covid-19 moratorium for April-October 2020 at half rent. The Tenant was thus liable for rent arrears, but the Tribunal offset this by recognizing the Tenant's entitlement to a refund of the deposit and reimbursement for proven renovation expenses due to flooding, which was the Landlord's responsibility under the lease. Claims for damages relating to the forecourt were rejected as the forecourt was not part of the demised premises.
