Ratio Decidendi

The Tribunal found that the applicant, being the deceased's son, had not demonstrated legal capacity to act on behalf of the deceased's estate as required by law. There was no evidence of a grant of letters of administration or appointment by the Commissioner under Section 17 of the Tax Procedures Act. Without such capacity, the application for extension of time to appeal was incompetent. The Tribunal therefore struck out the application for lack of locus standi, declining to exercise its discretion to extend time.
