The Defendant's actions in diverting the road into the Plaintiff's land and uprooting boundary posts constituted trespass. Although the Plaintiff did not prove special damages for the posts, he was entitled to nominal general damages for trespass. The Plaintiff established his case on a balance of probabilities and was entitled to a declaration, injunction, general damages, and costs.
