The court held that the applicant would suffer substantial loss if execution proceeded before the appeal was heard, particularly as the respondent's ability to refund the decretal sum was unknown. The court therefore granted a stay of execution on condition that the entire decretal sum be deposited in court within 30 days. The warrants of attachment and sale, as well as the proclamation notice, were set aside as they were issued before expiry of the interim stay.
