Legal Issues
- 1 Whether the applicant's remaining prison sentence for manslaughter should be substituted with a community service order in light of her personal circumstances.
Ratio Decidendi
The court found that, given the applicant had served a substantial portion of her sentence for manslaughter and in light of the sentence review report recommending a community service order for the welfare of her children, it was appropriate to substitute the remainder of her custodial sentence with a community service order to be served at Maua Police Station. The court exercised its discretion to ensure the best interests of the applicant's children while maintaining the punitive and rehabilitative objectives of sentencing.
Court Disposition
Application for sentence review allowed; custodial sentence substituted with community service order.
Orders
- The convict Doreen Kathambi is hereby put on a community service order for the remainder of her prison sentence to serve at Maua Police Station.
