Ratio Decidendi

The court found that the applicants had filed a complete record of appeal and that the appeal raised arguable issues warranting consideration by the appellate court. The tribunal's failure to provide cogent reasons for holding the applicants' motion in abeyance, coupled with the risk of prejudice and possible execution against the applicants if the tribunal proceedings continued, justified the grant of a stay. The court exercised its discretion to stay the proceedings before the tribunal, subject to the condition that the appeal be prosecuted within six months, to prevent rendering the appeal nugatory and to facilitate the applicants' right of appeal. Costs were awarded to the respondent.
