Ratio Decidendi

The District Magistrate acted outside his jurisdiction by awarding costs in excess of the statutory limit of Kshs 500 as provided under Section 171(1) of the Criminal Procedure Code. Furthermore, the failure to specify the sum awarded for costs in the conviction or order, as mandated by Section 174 of the Criminal Procedure Code, rendered the award null and void. The purported taxation of costs by consent of the parties is not supported by any provision in the Criminal Procedure Code. Consequently, the order awarding costs was a nullity and was set aside by the High Court in exercise of its revisionary powers under Section 364(1) of the Criminal Procedure Code.
