The Tribunal found that the applicant's rights as landlord were derived from a fixed-term license agreement with Kioko Investment Limited, which expired on July 1, 2022. After expiry, the applicant had no legal basis to claim rent or exercise landlord rights over the respondents. The respondents subsequently entered into new license agreements with Kioko Investment Limited and paid rent to it, establishing a new landlord/tenant relationship. By operation of section 5(1) of cap 301, the respondents became tenants of Kioko Investment Limited upon expiry of the applicant's license.
