The application was brought without unreasonable delay, the applicant demonstrated willingness to provide security, and the court was satisfied that substantial loss may result if stay was not granted, as the appeal could be rendered nugatory. The court exercised its discretion in line with the principles in Butt v Rent Restriction Tribunal, holding that the decretal sum should be deposited in an interest-earning joint account held by the advocates for both parties as security.
