The court held that although the appeal was settled out of court, the 1st respondent had actively pursued execution of the decree and the appellant had incurred costs in preparing for the appeal and seeking stay of execution. The 2nd respondent, as the judgment debtor, settled the decretal amount only after execution proceedings were initiated. Applying the general rule that costs follow the event, and considering the conduct of the parties, the court found that both the appellant and the 1st respondent were entitled to costs of the appeal.
