The court held that the applicants' reference was incompetent as it was filed out of time without leave of court, contrary to paragraph 11 of the Advocates Remuneration Order. The reasons for the taxing master's decision were contained in the ruling, and there was no justification for the delay or for seeking further reasons. Even if the reference were competent, the taxing master did not err in principle in assessing instruction fees, as the value of the subject matter was ascertainable from the valuation report (Kshs. 9,200,000), and the correct formula under Schedule 7 Rule 1(b) was applied.
